Terms of Use
In short: Hearthfrost is free to play. Frost Gems, heroes and other in-game items are part of the game, not real money, and you can't sell or swap them for money. Some features, like hero summoning, give random results, and the odds are shown in the game. Purchases go through Google Play, and Google Play's refund rules apply. Play fair, and keep the Heartfire lit. Nothing here takes away rights you have under the consumer laws of your country.
1. Who we are and what these terms cover
These terms are an agreement between you and SideQuest Studio ("we", "us"), based in Austin, Texas, USA. They cover the Hearthfrost: Winter Tribe game for Android (the "Game") and this website. By installing or playing the Game you agree to these terms and to our Privacy Policy. If you don't agree, please don't use the Game.
You must be at least 13 years old (or the minimum age of digital consent in your country, if higher) to play. If you are under the age of majority where you live, please read these terms with a parent or guardian, who must agree to them for you, and ask before buying anything. Purchases are made through your Google Play account and are also covered by the Google Play Terms of Service.
2. Your license to play
We give you a personal, non-exclusive, non-transferable, revocable license to install and play the Game on Android devices you own or control, for your own non-commercial entertainment. We keep all rights in the Game, including its art, music, characters, text, code and name. Please don't copy, sell, rent, modify, decompile or reverse-engineer the Game, or redistribute it, except where the law allows you to.
3. No account, and your saved game
The Game needs no account. Your progress is saved on your device (see the Privacy Policy). It can be lost if you uninstall the Game, clear its data, use Settings › Delete local data, or lose your device. Android's backup may bring it back, and the Save code in Settings lets you back up and move your tribe yourself. Keep your code safe, and don't load codes from people you don't trust. We can't restore progress that we don't hold.
4. In-game items, Frost Gems and purchases
- Virtual items. Frost Gems, scrolls, hourglasses, heroes, shards, builders, passes and other in-game items ("Virtual Items") are a limited license to use content inside the Game. They have no value outside the Game, are not money or property, and can't be exchanged for money, sold, traded or transferred, except where the law requires otherwise.
- Buying. Purchases are optional, and the Game can be played without paying. They are made and paid through Google Play. Prices are shown in your own currency before you confirm, and we never see your payment details.
- What you get. Each purchase is described in the Shop before you buy (for example "450 Frost Gems" or "No Ads"). Items are added as soon as Google Play confirms your payment. If a payment is pending, they are added when it clears.
- Passes that don't renew. The Frost Card (30 days) and the Winter Pass (one season) are one-time purchases for a limited time. They do not renew automatically, and you are never charged again unless you buy again.
- Restoring. One-time purchases such as No Ads, the Builder's Permit and the Warm Welcome Pack are linked to your Google account. If you reinstall the Game or move to a new device with the same Google account, tap Restore purchases in the Shop or in Settings. Gems and other items you have earned or bought are kept in your saved game, so keep your device backup on or save a Save code (see Support).
- Refunds. Refunds are handled under Google Play's refund policy. You can ask Google Play for a refund yourself (see Google Play's refund help); if you have a problem with a purchase, write to us at support@sidequest-labs.com with your Google Play order number (it starts with "GPA.") and we will help. If a purchase is refunded or charged back, the items it gave may be removed. Your statutory rights, including any right of withdrawal for digital content under the law of your country, are not affected. Where such a right exists, it may end once delivery has started with your consent.
- Changes to items. We may change, rebalance, rename or retire Virtual Items and game features as the Game develops. We won't remove an item you paid for without good reason, such as a refund or chargeback, fraud, or a legal requirement, and if we stop offering the Game we will give reasonable notice where we can.
5. Random rewards
Some features of the Game, such as summoning heroes, give randomized rewards. The drop rates are shown in the Game, on the Odds button of the Summon screen and in Settings › Odds & Help, and the Game applies the guarantees ("pity") that are described there. A random result is not a reason for a refund merely because you hoped for a different one.
6. Ads
The Game is free because it shows ads. Bonus videos are always optional and show their reward before you watch. A short ad may appear after some campaign victories, never during a fight, and not at all if you buy "No Ads". Ads are provided by Google AdMob; see our Privacy Policy for how ads use data and how to change your ad choices. We are not responsible for the content of third-party ads or the sites they lead to.
7. Playing fair
Please don't cheat, use hacks or automation that gets around the Game's limits, modify the Game or its save data to get items you haven't earned or bought, forge purchases, move your device's clock to claim rewards early, interfere with ads (for example with tools that fake ad views), or use the Game in a way that breaks the law or harms others. Because the Game runs on your device, we may reset or correct values that were obtained this way, or stop the affected features from working.
8. Updates and availability
We may update the Game to fix problems, add content, run events and seasons, or meet store and legal requirements. Some updates may be needed to keep playing. We may change or end a feature, an event or a season, and we will try to give reasonable notice of major changes. The Game is a single-player game whose progress is saved on your device. We work to keep it running well, but we can't promise it will always be available or free of bugs.
9. Our responsibility to you
We provide the Game "as is" and "as available". To the extent the law allows, we disclaim warranties that are not expressly stated in these terms, and we are not responsible for losses that were not reasonably foreseeable, for indirect or consequential losses, or for loss of saved data or Virtual Items. To the extent the law allows, our total responsibility to you for any claim about the Game is limited to the amount you paid us for in-game purchases in the 12 months before the claim.
Nothing in these terms limits responsibility that can't be limited by law, such as for death or personal injury caused by negligence, for fraud or willful misconduct, or your rights as a consumer under the law of the country where you live.
10. Ending these terms
You can stop using the Game at any time by uninstalling it. We may end your license if you seriously or repeatedly break these terms, and then you must stop using the Game. Sections 2, 4 (on the nature of Virtual Items), 9 and 11 continue to apply after these terms end.
11. Law and disputes
These terms are governed by the laws of the State of Texas, USA, without regard to conflict-of-law rules. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live and can bring a claim in your local courts. Before going to court, please contact us: most problems can be solved quickly by email.
12. Changes to these terms
We may update these terms, for example when the Game changes or the law requires it. We will post the new version on this page with a new "Last updated" date, and for important changes we will also let you know in the Game or on its store page. If you keep playing after a change, the new terms apply. If you don't agree to them, please stop playing and uninstall the Game.
